Why Brand Owners Need Specialty Coverage
Standard small-seller policies cap at $1M occurrence / $2M aggregate. Brand owners outgrow that the moment they sign a Target Plus, Costco, or Sam’s Club agreement. The reality of brand ownership is that your liability profile scales with your trademark portfolio, your SKU count, your retail commitments, and your channel mix.
We write coverage built around where your brand is going, not where it started:
- Higher product liability limits ($2M-$25M occurrence)
- Recall coverage tailored to your category
- IP & trademark defense
- Regulatory compliance alignment (FDA, FTC, CPSC, MoCRA, NSF/ANSI)
- Multi-channel coverage that doesn’t fight your channel mix
- Speed to bind, COIs to retailer specs typically same-day
Common Gaps
Where Standard Policies Fall Short
Recall (on standard policies)
Most $1M GL+PL policies do NOT cover recall costs. If a SKU goes wrong, you pay for retrieval, notification, and replacement out of pocket.
IP Enforcement Costs
Many policies pay only when YOU are sued. Going AFTER an infringer is a separate IP coverage line.
Regulatory Fines & Penalties
FDA, FTC, CPSC, MoCRA enforcement actions are typically excluded.
Foreign Manufacturer Failures
If your overseas contract manufacturer goes bankrupt, your domestic policy may not protect you.
FAQs
Questions Brand Owners Ask
What limits do brand owners actually need?
Most retailer programs require $2M occurrence / $4M aggregate. Costco, Target, Sam’s Club, and many wholesale chains require $5M or higher. We start most brand-owner clients at $2M / $4M with umbrella stacked to retailer specs.
Does product liability cover recalls?
Standard product liability covers third-party bodily injury and property damage from a defective product. It does NOT cover the cost of recalling, retrieving, replacing, or communicating about a defective product. Recall coverage is a separate endorsement we routinely add.
My contract manufacturer says they will indemnify me. Is that enough?
No. Indemnification is only as good as the indemnitor’s ability to pay. If your manufacturer goes bankrupt, has thin coverage, or fights the claim, you are exposed. Always carry your own primary coverage.
Do I need D&O if I am the only founder?
If you are raising capital, signing partnership agreements, considering exit, or have outside advisors, yes. D&O protects you personally from claims against your decision-making.
How fast can I get bound?
Most brand-owner quotes turn within a few business days. Once bound, COIs to retailer specs typically issue same-day.
